Terms & Conditions

Please review our rental policies carefully before making a reservation. These terms comply with Ontario and Canadian regulations.

1. Rental Eligibility

  • The renter must be at least 21 years of age. Renters under 25 may be subject to a young driver surcharge as per Ontario industry standards.
  • A valid Ontario driver's licence (G class or higher) or equivalent Canadian licence is required. International renters must present a valid International Driving Permit (IDP) alongside their foreign licence, as per Ontario Highway Traffic Act (HTA) regulations.
  • A valid credit card in the renter's name is required at the time of pickup for the security deposit.
  • The renter must not have any driving suspensions, prohibitions, or convictions for impaired driving within the past 3 years.

2. Insurance & Liability

  • All rental vehicles include the minimum third-party liability insurance coverage of $200,000 as mandated by the Ontario Insurance Act and the Compulsory Automobile Insurance Act (CAIA).
  • Optional Collision Damage Waiver (CDW) and Loss Damage Waiver (LDW) are available at an additional cost to reduce the renter's financial responsibility in case of damage or theft.
  • The renter is responsible for any damage to the vehicle not covered by insurance or waiver products, including but not limited to: interior damage, tire/wheel damage, undercarriage damage, and damage caused by negligence.
  • Personal effects and belongings left in the vehicle are not insured by Auto MDM Rental.

3. Payment & Security Deposit

  • A security deposit (pre-authorization) will be placed on the renter's credit card at the time of pickup. The deposit amount varies by vehicle class and will be communicated at the time of booking.
  • The deposit will be released within 7–14 business days after the vehicle is returned in satisfactory condition, subject to the renter's financial institution processing times.
  • Rental charges are calculated based on the rental period agreed upon at the time of booking. Additional charges may apply for late returns, extra mileage, fuel, tolls (407 ETR), cleaning, and traffic violations.
  • All prices are quoted in Canadian Dollars (CAD) and are subject to applicable Ontario HST (13%).

4. Rental Period & Returns

  • The rental period begins at the agreed pickup time and ends at the agreed return time. A grace period of 30 minutes is provided for returns.
  • Late returns beyond the grace period will incur additional hourly charges up to a maximum of one full additional day's rental.
  • Early returns do not qualify for a refund of unused rental days unless otherwise agreed in writing.
  • The vehicle must be returned to the agreed-upon location (970 Bathurst Street, Toronto, ON, M5R 3G6, unless otherwise specified). Failure to return the vehicle to the designated location may result in additional fees.
  • Under the Ontario Criminal Code (Section 335), failure to return a rental vehicle on time without prior arrangement may constitute a criminal offence.

5. Vehicle Use Restrictions

  • The vehicle may only be driven within the Province of Ontario and neighbouring Canadian provinces unless prior written authorization is obtained from Auto MDM Rental.
  • Cross-border travel to the United States requires advance approval and may incur additional insurance charges.
  • The vehicle must not be used for: illegal activities, racing or speed testing, towing or pushing other vehicles, transporting hazardous materials, ridesharing/commercial purposes (Uber, Lyft, etc.), or subleasing to third parties.
  • Smoking (including e-cigarettes/vaping) is strictly prohibited inside all rental vehicles. A cleaning fee of $250 will be charged for violations.
  • Pets are permitted only in approved carriers. A cleaning surcharge will apply if the vehicle requires additional cleaning after pet transport.

6. Accidents & Roadside Assistance

  • In the event of an accident, the renter must immediately contact local police (911), obtain a police report, and notify Auto MDM Rental at 437-545-3016.
  • Do not admit fault or liability at the scene of an accident. Exchange information with other parties and document the scene with photographs.
  • Under Ontario's Fault Determination Rules (Ontario Regulation 668), fault is determined based on the circumstances of the collision, not at the scene.
  • 24/7 roadside assistance is available for mechanical breakdowns and lockouts. The renter is responsible for costs arising from misuse, such as putting the wrong fuel type in the vehicle.
  • Towing and recovery costs resulting from off-road use, negligent driving, or driving under the influence are the renter's sole responsibility.

7. Fuel Policy

  • Vehicles are provided with a full tank of fuel. The renter is required to return the vehicle with a full tank.
  • If the vehicle is returned with less fuel than provided, a refuelling charge will be applied at prevailing market rates plus an applicable service fee.
  • For electric vehicles: the vehicle will be provided with a full charge. Charging costs during the rental period are the renter's responsibility.

8. Cancellation Policy

  • Cancellations made 48 hours or more before the scheduled pickup time will receive a full refund.
  • Cancellations made between 24–48 hours before pickup will incur a cancellation fee equivalent to one day's rental.
  • Cancellations made less than 24 hours before pickup, or no-shows, will be charged the full rental amount for the first day.
  • Auto MDM Rental reserves the right to cancel a reservation if the renter fails to meet eligibility requirements at the time of pickup.

9. Privacy & Data Protection

  • Auto MDM Rental collects and processes personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and Ontario's privacy legislation.
  • Personal information is collected solely for the purpose of processing rentals, managing accounts, and fulfilling legal obligations.
  • The renter's information will not be shared with third parties except as required by law, insurance claims processing, or traffic/toll violation enforcement.
  • Renters may request access to, correction of, or deletion of their personal data by contacting [email protected].

10. Governing Law & Dispute Resolution

  • This agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
  • Any disputes arising from this rental agreement shall first be addressed through good-faith negotiation between the parties.
  • If negotiation fails, disputes may be referred to the Ontario Small Claims Court (for claims under $35,000) or the Ontario Superior Court of Justice.
  • The Consumer Protection Act, 2002 (Ontario) applies to this agreement, and nothing in these terms shall be construed to limit the renter's rights under applicable consumer protection legislation.
